  • The settlement is not considered reasonable by the victim
  • The demanded settlement isn’t considerable by the plaintiff
  • The defendant doesn’t offer any compensation at all which leaves no option left for the victim.

Reject and Negotiate

In many cases, the offer is not directly made by the plaintiff rather by the insurance company. The plaintiff and the insurance company will closely work together to come up with a quote that they will present to you. Specific reasons can make you think the settlement is insufficient or doesn’t cover all of your damages. In case you are rejecting the offer, you will be required to write a formal letter to the company. The letter will state why you demand more money and on what basis you are making such a claim.

However, after rejecting the settlement, you should keep your options open by negotiating further. Keep on counter offering what you expect from the insurance company.

This might be something not very frequent but there are chances that after you reject a settlement, the adjuster might not offer another deal. In such a case, the settlement becomes non-negotiable. Initially, when you reject a settlement, you might think that you don’t have to pay any fees or anything but in case you are unable to support your claims in court, you will not be able to get the compensation and also pay for it.

When you consider the offered settlement and reflect upon declining it, it is imperative that you pay attention to all the factors that are involved. You shouldn’t expect more than what you deserve because that will only weaken your case in court. Only demand compensation that you truly deserve and are able to defend it in court.
